Is it free speech or disturbing the peace? That's the question promoters of a new energy drink are asking after being arrested for simply saying the product's name this weekend.

"(Seth Garrett) says in a megaphone, 'Come get Sum Poosie, the nation's hottest new energy drink,'" Sum Poosie's Gainesville sales rep Jarret Rosenberg says. "And the next minute you know, they guy comes up and arrests him."

But Gainesville Police say Garrett wasn't saying the name of the drink. Instead, he used only the second part. And that, police say, is what got him arrested for disorderly conduct.

"When you're dropping out some letters on the drink, and you're doing things that by state statute could be against public morals, we gave a notice to appear," says Sgt. Keith Kameg.

Rosenberg says he and several other people were promoting the drink across from the UF campus Saturday.

"Nobody complained," he says. "Everybody was laughing."

But not everyone thought it was funny. A mother with her 10-year-old daughter asked police to do something about the graphic language.

"You have to look at what the families were looking at, and actually how it was said," says Kameg. "And you weren't talking about the brand name at this point, because the brand name and what was said were two very, very different things."

But beverage promoters still think police overreacted.

"Who gets arrested for selling an energy drink?" says Rosenberg.

Rosenberg says Garrett has to go to court in a couple of weeks on the charge. Kameg says this minor charge very well could come down to a major issue of First Amendment free speech.

I know a couple of guys who were dumb enough to get financially involved with this product and they are hitting themselves in the head right now.

If you are going to have a product with a name like this then at least have the brains to advertise it as tastefully as possible (if that even IS possible with this junk)

But to hire a bunch of punks who just want to go around and be able to yell "Get some poosie" through a f**kin megaphone"

I say to all you guys who are either working for or investing in SUM POOSIE - grow the f**k up already - it's time to stop acting like a bunch of 15 year olds who havn't gotten laid yet and are foaming at the mouth cause they just saw their first set of t**s.

That is to funny. Yeah, I am against the person who is always out looking for trouble. The mom who thinks the world needs to change in order to protect her children from all the wrong doings and all the words out there. But, if this guy is screaming into a crowd "Come and get your *****", then yeah, that is just wrong. I love how one min. this company is telling everyone, no, its just a play on words, we have nothing to do with that. Then next min. they are yelling to get your *****. That is just to funny and shows this company is full of crap. I still have yet to see it anywere.

I can walk into any bar and order sex on the beach, a buttery nipple, and I can even order a blow job..... and some how SumPoosie is too much.... The cop that made the arrest later said he was sorry and that is on tape. The day someone can't say Poosie without fear of arrest is the day I leave America. Free speech is free speech, the officer was wrong and admitted it. SumPoosie continues to grow face the facts. tongue.gif

What, get a job? Got one already. Difference here is that people are not out on the streets with a bullhorn shouting out for blowjobs or purple nipples or anything like that. Hey, in a bar or a strip club, no problem. But when your company wants to defend itself by saying "No way, we are not advertising ourselves as *****, we advertise our cat "poosie"'. Then you have someone representing you saying get your ***** right there. It doesnt work both ways. Listen, I don't really care about your drink in terms of a threat. I don't sell an energy drink, and I have never seen your drink, ANYWERE. But I do have a problem with people just not saying it how things really are. Sum Poosie is obviously a strip club bar drink, and that is why you came out with Think Pink. Just admit what you are doing and you will be cut some slack. If not, then we will all continue to think that you have zero credability.

Thanks Soda... Everyone really likes the new bottle caps. They are going to be adding a few other cool things on the new labels. The 2004 bottle models are coming out next month and that should be really cool. Ron what can I say .... you have know idea what you are talking about ... it seems like you rarely do. Our guy was on a blow horn outside a campus bar right after the Florida game shouting "Want Sum Need Sum? Get SumPoosie here!! There is nothing criminal about what he did whatsoever. The officer was wrong and admitted he over reacted. Free speech is free speech whether you are in a bar or not. Think Pink is a sugar free carb free drink being put out by another company. You have DICKEN Cider, Energy 69, and a copy cat called Sex Kola with girls on the bottle in Pin up art style...hmmmm sound familiar. Enjoy the new caps Poosie the Cat rocks!!!! ;)

my friend is still dusting off the sum poosie bottles he's had since June in his upscale Italian restaurant. I told him if he wants to make money off of sum poosie, he needs to change his restaurant to a strip club instead. Then those things will go flying out the door....at least that's what "energydoode" would have us believe.

I think all the energy drinks with overtly sexual names are going to be narrowing their own marketing & placement avenues. Unless it's PimpJuice - cause everyone knows it's cool now to be a pimp.....50 Cent said so himslef on the MTV Video Music Awards :D

I have seen Sum Poosie in two different stores out of about 500 I go into every few weeks and I'm here to tell ya that the five cases that are in the cooler at each of these stores are the same five cases that have been there since they were delivered.

Say what you want people hate it LMAO!

I would like to see the new bottle that's been talked about now for like six months on this message board but I don't guess I ever will since the TWO stores that have it can't order more cause they can't sale one bottle out of the five cases they have collecting dust.

Well, maybe I rarely know what I am talking about, or maybe I do. Difference between me and you is, my company can sell our drink in almost all markets. You my friend are limited to strip clubs and bars. Thats your nitch, fine, no problem here. Just stop talking like you have the best drink in the world and everbody loves it and it is flying off of shelves everywere. Only a couple dist. that I know have carried it, and they have both droped it since. The only time I have seen it is in the playboy mag, and on your website. Untill you actualy get some product placement and dist., stop all the sales pitches. No one here is buying.

Get your facts straight. The police did not admit they were wrong. The charges were dismissed by the State Attorney's Office.

Hey thanks for the link but what article were you reading. They admitted they were dead wrong and from what I understand, the company is looking at all their legal options. We live in a country that offers us all free speech and unfortunately one officer in Gainsville forgot that. You have not heard the last of this case. They still have not apologized to the young man they arrested for no reason. smile.gif

The man yelled the vulgarity three times to a group of adults and children leaving the football game, the report stated.

The officer was wrong dead wrong and that is why they dropped the case and tucked their tails. We have a thing called free speech and yelling "hey get SumPoosie here" is not a violation of any kind.....at least not in this country! By the way SumPoosie starts in NY and NJ next week.............. :D

If I had a little child - especially a daughter - and I was walking with her and this punk yelled an obscenity, he would have that megaphone stuffed down his throat - so the cops wouldn't have any dilemma at all.

If you're in a bar - fine. If you're at spring break where there are no kids - fine. But NOT in public where kids are or moms are present. This just proves how NON mainstream this product is and always will be. So if they want to go the NON conventional route - keep it out of view of the general public - period!!

Great!..........someone else who does not know the facts. The facts are that this was in front of a bar. It was right after the Florida game right on bar row in Gainsville. Little children were not mulling about. If they were the question would be why are they within 50 feet of a bar? What you all seem to be missing is a Police officer grabbed Seth and slapped cuffs on him without so much as a explanation. Meanwhile, other officers were drinking SumPoosie and getting T-Shirts. Know the facts and quit slamming a great drink for no reason. For 20 years people have been ordering Sex on the Beach, Screaming Orgasms, and Blowjobs at the bar. Surely ordering SumPoosie with a Poosie Cat on it is not the end of the world.

But like he said, in a bar or strip club then fine. Since that is the only place your product will move. But the cop, if he felt the guy was screaming something that would incite a riot or cause a fight or something to break out, he did the right thing. You say the cop appologized afterwards. OK, that doesnt mean that the cop was wrong in what he did. It just means that the situation might have ended and he felt no need to press the law any further. I have never been to that part of town in Florida, I do not know if there are not other busneses other than bars. Maybe children should have been there, and maybe not. But noise polution is a crime, don't forget that.

Energydud, you're the one reading into the article. The cop did not admit he was wrong. The cop did not drop the case. The state attorney's office did. Big difference. I'm sure the cop and the parents who complained would have loved to see the case go to trial.

Ok.. hello! What videotape? Does the article mention a videotape? Did you mention this videotape before? Jesus, man.. Get your facts straight. I know nothing about this videotape, or this whole stupid incident, except what I have read on this thread, and in the two news articles. Outside of Gainesville, was this even reported on in other papers?

And yes, I know why they dropped the charges. Why resport to calling me an idiot?

Ok, let's say you were just average Jane walking by and heard a guy yelling that phrase. If you had NO idea what Sum Poosie energy drink was, wouldn't it suprise you? Maybe offend you if you had small children with you? And personally, I think he said it that way to play on the sexual innunendo-ness of the name. And it is the police's duty to serve and protect, so the cop felt like he was doing the right thing. Did the cop know what Sum Poosie was before the incident?

Hell, I've never even seen Sum Poosie anywhere around here. I could give a rat's ass about it.

Obviously concerned parents are the ones who care about people yelling about poosie. Taken out of the context of the energy drink market, it is a vulgar statement. I'm no prude, but I'd be suprised if I heard someone yelling that out.

We all know the name is a not-so-clever play on words. But to the untrained ear, it can be disgusting.

Maybe you should take some time out of your busy schedule and devlop a little bit of decency and concern for your fellow humans.

And yes, we do have running water. Delaware is no different than any other state in the US. It's just the second smallest one, that's all. Most corporations incorporated in this state, and many of the largest banks have chosen to locate their headquarters or a big portion of their staff in this state.

Let's not forget (if you're a race fan, which I am not). .we have Dover International Speedway. Also located nearby is Dover Air Force base, which is the first stopping point for our deceased soldiers and military personnel. It's also a major cargo shipping point for the military.

And we are also smart enough to follow in other states' footsteps and enact a public smoking ban.

And lastly, thankfully we don't have some dude running around yelling about his poosie. I can only speak for myself, but i would never even consider accepting any poosie from a MAN.

Fusion ....... If you get SumPoosie from a man........he is not a man!!! I think yoiu might have to have a refresher course, stop by any 6th grade health class they can help you out. Secondly, free speech is exactly about saying what you want.
Like I said before free speech is about protecting speech we do not like fowl or otherwise. Saying bad words may be distasteful to some but it is not a crime. ;)
