If one were to ponder the development of a new beverage, which would contain a few herbal ingredients which collectively produce a noticeable increase in the drinker's state of mind/mood, what advice would you give? ie how would such a beverage fit in legally? One would assume it's legal for a beverage to produce a mood uplift as long as it doesnt contain any illicit ingredients....st johns wort tea and kava kava (and even coffee) are a few such examples of beverages which enhance the user's state of mind. But what if you were to make a beverage which provided an even more significant lift in mood? Where would you draw the line/when would you need to worry about people calling it a "drug" and worrying of the FDA threatening to remove it from the market, etc?
