Bang Energy maker Vital Pharmaceuticals (VPX Sports) has filed an expedited motion for a preliminary judgement in its legal battle with Monster Energy Corp. over alleged trade dress infringement related to the latter’s REIGN line.
According to documents from Amsterdam District Court in The Netherlands shared by Monster last night, the energy drink maker’s Dublin-based European subsidiary, Monster Energy Limited, has received a partial judgement in its complaint against Bang B.V., which markets and sells VPX’s Bang energy drink in Holland.
Monster Energy has fired back against Vital Pharmaceuticals (VPX Sports) in a First Amended Complaint that accuses the Bang maker of “flagrant consumer deception and anti-competitive business practices.”
In a complaint filed yesterday in U.S. District Court Southern District of Florida, Florida-based VPX accused Monster of trademark infringement, trade dress infringement, and unfair competition over its use of “REIGN,” which Monster announced as the name of its recently debuted performance energy drink in January.
