Insider Subscription Purchase Terms

These Terms of Purchase govern the sale of subscription services (the “Subscription”) to our website and other digital media content (the “Digital Publications” as defined below) offered by BevNET.com, Inc. (“BevNET). By purchasing the Subscription you agree to the terms contained herein. By accessing or using the Digital Publications, you also agree to our General Terms and Conditions and Privacy Policy.

1.  Digital Publications.

1.1 BevNET.com, Inc.’s Digital Publications include the websites and mobile sites (www.bevnet.com, www.brewbound.com, www.nosh.com, www.tasteradio.com), the mobile apps and RSS feeds associated with each website, and daily email newsletters. You are not necessarily required to purchase anything to access the Digital Publications. If you do not purchase a Subscription, however, your access to the Digital Publications will be limited.

1.2 BevNET reserves the right to modify the content, type and availability of the Digital Publications at any time. We may also impose limits on certain features and services or restrict your access to parts or all of the Digital Publications without notice or liability. If you do not cancel your Subscription for the Digital Publication(s) after the modifications become effective, you agree to the modifications.

2.  Billing, Payment, and Subscription Renewals.

2.1  All Subscriptions are auto-renewing. If you purchase a monthly Subscription, your account will automatically renew one month after your purchase date and each month thereafter (the “Renewal Date”), unless you cancel in advance of your renewal date. If you purchase an annual Subscription your account will automatically renew one year after your purchase date and each year thereafter (the “Renewal Date”), unless you cancel in advance of your renewal date. For annual subscriptions, we will notify you of the pending renewal at least 5 days before the Renewal Date,except as otherwise required by law, by emailing the main billing contact on your account.

2.2  You may cancel or modify your Subscription any time prior to your Renewal Date by logging into your subscription portal at https://app.bevnet.com/subscription, navigating to the the Billing tab, and clicking the Cancel Renewal button. If you have issues accessing your account, you may also contact us at support@bevnet.com prior to your Renewal Date for help with your cancellation.

2.3  If you purchase your Subscription on our website with a credit card, your credit card will be automatically charged for any applicable account renewal fees (unless your Subscription is canceled in accordance with the terms described in section 2.2), account upgrades that you initiate, additional users that you purchase, or any other additional purchases that you make through your account. You are responsible for updating your billing information and credit card details to ensure that your account information is always accurate. You may update your billing information in your subscription portal by logging into https://app.bevnet.com/subscription and navigating to the payment tab or by contacting us at support@bevnet.com. If you purchase your Subscription through our sales department using an order form or purchase order, we will invoice you according to the terms of the purchasing document. Unless otherwise agreed to in writing, all payments are due in full 30 days from the invoice date. You are responsible for contacting us at support@bevnet.com to update your billing contact details.

2.4  EXCEPT AS OTHERWISE STATED HEREIN OR REQUIRED BY APPLICABLE LAW, YOUR SUBSCRIPTION OR PURCHASE FEE IS NONREFUNDABLE. If you cancel or stop using your Subscription, you are not entitled to receive any refund or credits, including for the time remaining in your billing period, and you will continue to have access to your Subscription until the end of your current billing period (unless we provide you with a refund or credit). We reserve the right to issue refunds or credits at our sole discretion. If we issue a refund or credit in one instance, we are under no obligation to issue the same refund or credit in the future.

2.5  We reserve the right at any time to modify the Subscription fees. We will notify you in advance of any fee changes that will affect your account by emailing the main billing contact and/or administrator of your Subscription, at which time you may choose to cancel or modify your subscription according to the terms detailed in section 2.2.

3.  User Accounts and Security.

3.1  When you purchase or sign up for a Subscription, you will create login credentials by providing an email address to us and by selecting a password. You may also log into your Subscription account by using the Google login associated with your email. Each login is for a single user only. You are not allowed to share or disclose your login credentials with any other user or person. We may cancel or suspend your access to the Subscription if you share your credentials. You or the Subscription’s administrator may, however, reassign your user account to another employee or contractor of your company if you no longer need access to the Subscription. 3.2  You are responsible for the security of your login credentials and for managing access to and use of your account and will be liable for any misuse of your account. You will notify us immediately at support@bevnet.com if you learn or suspect that your account has been accessed without proper authority or by a person other than you. Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of your account, at our sole discretion, and we may refer you to appropriate law enforcement agencies.

3.3  You must be 18 years or older to purchase or register for a Subscription.

4.  Restrictions of Use.

4.1. The contents of the Digital Publications are intended for your personal, noncommercial use. All materials published on the Digital Publications (including, but not limited to news articles, photographs, images, illustrations, audio clips and video clips, also known as the “Content”) are protected by copyright, and owned or controlled by BevNET or the party credited as the provider of the Content. You shall abide by all additional copyright notices, information, or restrictions contained in any Content accessed through the Digital Publications.

4.2. The Digital Publications and Content are protected by copyright pursuant to U.S. and international copyright laws. You may not modify, publish, transmit, participate in the transfer or sale of, reproduce (except as provided in Section 2.3 of these Terms , create new works from, distribute, perform, display, or in any way exploit, any of the Content or the Digital Publications (including software) in whole or in part.

4.3. Notwithstanding the above, you may download or copy the Content and other downloadable items displayed on the Services for personal use only, provided that you maintain all copyright and other notices contained therein. Copying or storing of any Content for other than personal use is expressly prohibited without prior written permission from BevNET, or the copyright holder identified in the copyright notice contained in the Content.

5.  Third Party Content and Links.

5.1  The Content is owned or licensed to BevNET. Certain Content is furnished by third party agencies such as the Associated Press and Reuters. BevNET will not be liable for any delays, inaccuracies, errors or omissions in any such third party Content, or in the transmission or delivery of all or any part thereof, or for any damages arising therefrom.

5.2. The Content may contain links to third party websites, resources, and advertisers. Since we are not responsible for the availability of these outside resources, or their contents, you should direct any concerns regarding any external link to the site administrator or webmaster of that website.

6.  Changes to the Terms of Purchase. We may, from time to time, change these Terms of Purchase. When such changes are made, we will make a copy of the new Terms of Purchase available to you on our website. If you do not cancel your Subscription after the changes become effective, you agree to the changed terms.
