Red Bull settles with Roxy over substitute drinks

SANTA MONICA, Calif  – Red Bull North America settled a lawsuit with Roxy, the Orlando, Fla.-based nightclub that Red Bull claimed routinely substituted other beverages when customers asked for Red Bull, Beverage World reported.

The settlement includes a permanent injunction against Roxy and its employees that bars them from “passing off” other beverages as Red Bull. Roxy also agreed to pay Red Bull an undisclosed amount, BW reported.

Red Bull told BW that they pursued the lawsuit to protect the integrity of the brand, protect consumers in the marketplace and teach establishment owners that substituting products is illegal and Red Bull is willing to pursue aggressive legal actions.
